The Occupational Safety and Health Administration (OSHA) can fine employers for having uncertified forklift drivers:
Fines for employers
OSHA can fine employers up to $70,000 for each forklift operator who is not certified. The fine can increase if the employer is found to be willfully negligent.
Fines for individuals
Individuals who make false claims about their certification can be fined up to $13,653 and imprisoned for up to six months.
OSHA also has penalties for other forklift violations, including:
Serious violations: Maximum penalty of $16,131 per violation
Other-than-serious violations: Maximum penalty of $16,131 per violation
Failure to abate: Penalty of $16,131 per day after the abatement date
Willful or repeated violations: Maximum penalty of $161,323 per violation
OSHA requires that forklift operators obtain and renew their certification every three years. Certification may need to be renewed sooner if:
The operator is involved in an accident
The operating environment or equipment changes
The operator is observed driving unsafely
OSHA estimates that 25% of forklift accidents are caused by inadequate operator training.
